Terms of Service

• A landlord, property manager, agent, contractor, or decision-maker authorized to act for the property owner.
• Another person with lawful authority to request the applicable information or services.

You may not submit another person’s contact, property, or project information without appropriate permission or legal authority.

The Services provide information and tools that may help users explore residential window replacement or installation projects, review potential partner offers, submit project information, and request contact from participating providers.

We may change, suspend, replace, restrict, or discontinue any portion of the Services at any time, with or without notice, subject to applicable law.

We may operate as an advertising, marketing, information, lead-generation, lead-distribution, or provider-matching service. Unless expressly stated otherwise, we are not the contractor, manufacturer, installer, lender, or provider that performs the requested project or supplies the products or services.

Participating providers are independent businesses. They are not our employees, agents, partners, joint venturers, or representatives merely because they receive or respond to an inquiry through the Services.

How matching may occur

A project inquiry may be evaluated or routed according to factors such as:

• ZIP code, city, state, or geographic service area.
• Window count, project type, property type, timing, or installation requirements.
• Your stated provider or offer preference.
• Provider capacity, availability, routing agreements, campaign requirements, or lead-acceptance criteria.
• Technical, fraud-prevention, duplicate-lead, consent, or compliance requirements.

A request to prioritize a provider does not require that provider to accept, purchase, contact, quote, schedule, or serve the inquiry.

The Services may display, summarize, reference, or collect interest in promotions, product discounts, order savings, installation opportunities, consultation offers, financing options, or other provider programs.

Unless expressly stated in a written agreement issued by the applicable provider, information displayed through the Services is for general informational and matching purposes only.

Provider confirmation is required

A participating provider must independently confirm all material terms, including:

• Product eligibility, style, color, size, shape, glass, configuration, and installation requirements.
• Minimum purchase, window count, order size, geographic area, property, or project qualifications.
• Pricing, measurements, estimates, discounts, credits, exclusions, fees, taxes, permits, and installation costs.
• Offer availability, combination rules, substitutions, changes, cancellation, and final written terms.
• Appointment availability, project schedule, delivery, installation, warranties, and service obligations.

Financing

We are not a lender unless expressly stated otherwise. Financing may be offered by independent providers or third-party lenders and is subject to application, credit approval, underwriting, lender terms, rates, fees, repayment requirements, project eligibility, and geographic availability.

Promotional financing may involve deferred payments, deferred interest, accrued interest, minimum payments, or other conditions. Review the complete written credit disclosures before accepting financing.

You agree that information you submit through the Services will be accurate, current, complete, and submitted for a lawful purpose.

You agree not to:

• Submit false, misleading, fraudulent, fictitious, incomplete, or outdated contact or project information.
• Impersonate another person or misrepresent your identity, authority, ownership, or relationship to a property.

We may reject, suppress, quarantine, restrict, or delete a submission that appears inaccurate, unauthorized, fraudulent, automated, abusive, duplicative, or otherwise inconsistent with these Terms.

When you submit a form and provide the requested consent, you may authorize us, our service providers, and participating window, home-improvement, financing, or related providers to contact you regarding your inquiry.

Communications may include telephone calls, text messages, prerecorded messages, automated technology, email, or other electronic communications. Message frequency may vary. Message and data rates may apply.

Consent to receive marketing communications is not a condition of purchasing goods or services.

Electronic communications

You consent to receive agreements, notices, disclosures, confirmations, and other records electronically where permitted by law. You are responsible for maintaining accurate contact information and access to a compatible device, internet connection, and email account.

Communication preferences

You may not:

• Violate any applicable law, regulation, court order, contractual obligation, or third-party right.
• Use the Services for fraud, deception, harassment, intimidation, abuse, discrimination, or unlawful solicitation.
• Introduce malware, viruses, harmful code, automated attacks, denial-of-service activity, or unauthorized scripts.
• Scrape, crawl, harvest, extract, index, copy, mirror, or monitor the Services through automated means without written permission.
• Circumvent access controls, rate limits, bot protection, fraud controls, security measures, or technical restrictions.
• Attempt to gain unauthorized access to accounts, networks, systems, databases, APIs, forms, routing systems, or provider information.
• Reverse engineer, decompile, disassemble, or attempt to derive source code from protected portions of the Services, except where such restriction is prohibited by law.
• Use the Services to build a competing database, directory, lead-generation service, marketing list, or commercial product without written authorization.
• Remove, alter, obscure, or misrepresent copyright, trademark, attribution, consent, disclosure, or proprietary notices.

You grant us a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, transmit, adapt, disclose, and use Submissions as reasonably necessary to:

• Process and route your inquiry.
• Communicate with you and participating providers.
• Prevent fraud, enforce these Terms, and comply with law.
• Create aggregated or deidentified information where permitted.

You represent that you have the rights and permissions necessary to submit the material and grant this license.

Feedback

If you provide ideas, suggestions, recommendations, or feedback about the Services, we may use them without restriction or compensation, unless prohibited by law or agreed otherwise in writing.

The Services may reference or link to participating providers, lenders, manufacturers, contractors, social-media platforms, analytics providers, advertising services, financing resources, or other third parties.

Third-party websites, products, services, offers, communications, estimates, contracts, warranties, and privacy practices are governed by the third party’s own terms and policies.

We do not control and are not responsible for:

• A provider’s licensing, insurance, qualifications, employees, subcontractors, materials, methods, pricing, scheduling, workmanship, warranties, or performance.
• A lender’s underwriting, approval, credit decision, interest rate, fees, payment schedule, disclosures, or servicing.
• The content, availability, security, accuracy, legality, or privacy practices of an external website or service.
• Any transaction, contract, disagreement, injury, damage, delay, loss, or dispute between you and a third party.

Review all third-party terms, written estimates, contracts, disclosures, licenses, warranties, and policies before entering into a transaction.

To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, quiet enjoyment, and any warranty arising from course of dealing, usage, or trade practice.

We do not warrant that:

• The Services will be uninterrupted, timely, secure, error-free, complete, accurate, or available at all times.

• A project will produce any particular savings, energy performance, comfort, appearance, property value, tax result, environmental outcome, or other benefit.

This limitation includes damages arising from or relating to:

To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of:

1. The amount you paid directly to us, if any, to use the Services during the six months preceding the event giving rise to the claim.
2. One hundred U.S. dollars ($100).

The limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose or we were advised of the possibility of damages.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, liability will be limited to the maximum extent permitted by law.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its affiliates, owners, officers, directors, employees, contractors, agents, licensors, and service providers from and against claims, actions, proceedings, liabilities, damages, losses, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to:

• Your access to or use of the Services.
• Information or material you submit.
• Your violation of these Terms or applicable law.
• Your infringement, misappropriation, or violation of another person’s rights.
• Your unauthorized submission of another person’s contact, property, or project information.
• Your fraud, misconduct, negligence, or unlawful activity.

We reserve the right to control the defense and settlement of a matter subject to indemnification. You agree to cooperate reasonably with that defense.

Except where federal law or the arbitration provisions apply, these Terms and disputes arising from them will be governed by the laws of REPLACE_WITH_GOVERNING_STATE, without regard to conflict-of-law principles.

For disputes that are not subject to arbitration or small-claims court, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in REPLACE_WITH_GOVERNING_COUNTY, REPLACE_WITH_GOVERNING_STATE, unless applicable law requires otherwise.

Nothing in these Terms limits rights that cannot lawfully be waived under the law applicable to you.

• Your use creates security, legal, operational, fraud, or reputational risk.
• Your submission is false, unauthorized, abusive, automated, duplicative, or fraudulent.

• The Services or applicable business relationship is being modified or discontinued.

Provisions that by their nature should survive termination will survive, including ownership, licenses, disclaimers, liability limitations, indemnification, dispute resolution, and general legal provisions.

Severability

No third-party beneficiaries

Force majeure

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, labor disputes, war, terrorism, government action, utility interruption, internet failure, cyberattack, platform outage, public health emergency, or supplier failure.
